General Terms and Conditions (GTC)
§ 1 Scope
The deliveries, services, and offers of the seller are made to private end consumers and business customers exclusively on the basis of these terms and conditions.
§ 2 Offer and Contract Formation
2.1 The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalogue. By clicking the button [Order with obligation to pay], you place a binding order for the items contained in the shopping cart. Confirmation of receipt of your order is sent by automated email immediately after the order is submitted and does not yet constitute acceptance of the contract. We may accept your order by sending a separate order confirmation by email within two days.
2.2 Once you have found the desired product, you can view it in more detail without obligation by clicking on the product name, the product image, or the "Info/Order" link. By clicking the [Add to Cart] button, you can place the item in your shopping cart. You can view the contents of your shopping cart at any time without obligation by clicking the [Shopping Cart] or [Checkout] link. You can remove or change products in the shopping cart by clicking the [Remove] and [Update Quantity] icons. If you wish to purchase the products in your cart, you can complete the online ordering process. To order through our online shop, click the [Submit] button on the "Shopping Cart" page, where you can enter and manage your addresses.
The online ordering process comprises five steps. In the first step, "Shopping Cart," you can review your items again and edit them if necessary (delete or change quantities). In the second step, "Submit," you can optionally set up a customer account with us if this is your first purchase — click [Open Customer Account] under "I am not yet a customer." If you already have a customer account, log in here under "I am already a customer" using your login details. Under "Order without registration," you can also order without creating a customer account. In the next step, "Payment," you can select your preferred payment method. In the fourth step, "Order," you will receive an overview of your order details and can review, delete, or change all information using the [Edit] button. You can also correct input errors by navigating backwards in your browser or by cancelling the ordering process and starting again. In the final step, "Done," your order number is displayed for any future queries.
To complete your purchase, you must accept our General Terms and Conditions and click the [Buy Now] button. This submits your order to us. We will then send you a confirmation of receipt of your order by email, followed by a separate order confirmation, which is when the contract is concluded.

§ 3 Storage of Your Order
We store your order and the order data you have entered. We will send you all order details again by email. You also have the option to print both the order and the General Terms and Conditions before submitting your order to us. Additionally, you can access your orders at any time through your customer account.
§ 4 Cancellation Policy
Right of Withdrawal for Consumers — The following right of withdrawal applies only to consumers:
Cancellation Policy — Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the last item of goods. To exercise your right of withdrawal, you must inform us (Hoco Online GmbH, Edisonstraße 63, Building E 1st Floor, D-12459 Berlin, support@leatt.de, Phone: +49 30 9599811-33) by means of a clear declaration (e.g. a letter sent by post, fax, or email) of your decision to withdraw from this contract. You may use the enclosed model withdrawal form for this purpose, although it is not mandatory. To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period expires.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (with the exception of any additional costs arising from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment that you used for the original transaction for this refund, unless expressly agreed otherwise with you; under no circumstances will you be charged fees for this refund. We may refuse the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period has expired. You bear the direct costs of returning the goods. You are only liable for any diminished value of the goods if this diminished value is due to handling that is not necessary for testing the nature, characteristics, and functioning of the goods.

100-Day Free Returns
In addition to your statutory right of withdrawal, under the following conditions you may return goods delivered by us within 100 days (starting the day after receipt of the goods) to us, Hoco Online GmbH, Sarirstr. 3, 12529 Schönefeld. For returns within Germany, we cover the postage costs.
The goods must show no signs of use and must arrive complete and in their original packaging within the 100-day period.
Your statutory 14-day right of withdrawal and your statutory warranty rights naturally remain unaffected! Until your statutory right of withdrawal has expired, the conditions stated in the cancellation policy apply exclusively.
Special Notes:
If you finance this contract through a loan and subsequently withdraw from it, you are also no longer bound by the loan agreement, provided that both contracts form an economic unit. This is particularly to be assumed if we are also your lender, or if your lender makes use of our cooperation with regard to the financing. If the loan has already been disbursed to us when the withdrawal takes effect, your lender steps into our rights and obligations under the financed contract in relation to you with regard to the legal consequences of the withdrawal or return. The latter does not apply if the present contract concerns the acquisition of financial instruments (e.g. securities, foreign currencies, or derivatives). If you wish to avoid a contractual commitment as far as possible, exercise your right of withdrawal and also withdraw from the loan agreement if you also have a right of withdrawal in respect of that agreement.
§ 6 Prices and Payment
6.1 All prices include VAT plus shipping costs.
6.2 Payment can be made by advance payment, cash on delivery, credit card, direct debit, PayPal, instant bank transfer, installment purchase, or invoice. We reserve the right to exclude individual payment methods.
6.3 Payments are due only after the order confirmation has been sent to you by email. For advance payment, we will provide you with the bank details for the advance transfer in the order confirmation. For payment by credit card and direct debit, the charge to the credit card or specified account is made upon dispatch of the goods. For payment via PayPal and instant bank transfer, payment is made during the ordering process. For payment by invoice (invoice purchase via Payolution), the ordered goods are dispatched or delivered together with the invoice. The purchase price is due for payment within 30 (thirty) calendar days of the invoice date.
The invoice is generally enclosed with the shipment.
§ 7 Delivery
7.1 We deliver to all countries listed here.
7.2 If, through no fault of our own, we are unable to deliver the ordered goods because our supplier has not fulfilled its contractual obligations, we are entitled to withdraw from the contract with the customer. In this case, the customer will be informed without delay that the ordered product is not available. The customer's statutory rights remain unaffected. Any purchase price already paid will be refunded without delay.
§ 8 Warranty
The warranty is provided in accordance with statutory regulations. For information about any additional manufacturer guarantees, please refer to the product information.
§ 9 Battery Return
Notice pursuant to the Battery Act: In connection with the sale of batteries and rechargeable batteries, we as a retailer are obliged under the Battery Act to inform our customers of the following:
You are legally required to return used batteries and rechargeable batteries after use. As an end consumer, you can return old batteries and rechargeable batteries from our range free of charge at our dispatch warehouse or send them back to us. You can also return old batteries and rechargeable batteries at a local municipal collection point or at a local retailer. Please note that you must not dispose of batteries and rechargeable batteries in household waste. This is indicated by the image of a crossed-out waste bin on the batteries and rechargeable batteries.
The improper disposal of batteries and rechargeable batteries can have harmful effects on the environment and human health due to the substances they contain. For this reason, the separate collection and recycling of old batteries is of particular importance for the environment and health. Batteries and rechargeable batteries are also marked with the chemical symbol of the respective hazardous substance they contain. Batteries containing more than 0.0005% by mass of mercury, more than 0.002% by mass of cadmium, or more than 0.004% by mass of lead are marked with the chemical symbols of the metals (e.g. "Cd" for cadmium, "Pb" for lead, "Hg" for mercury).
§ 10 Governing Law and Jurisdiction
10.1 German law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
10.2 For customers who enter into the contract for a purpose that cannot be attributed to their professional or commercial activity (consumers), this choice of law applies only to the extent that it does not deprive them of the protection afforded by the mandatory provisions of the law of the country in which they have their habitual residence.
10.3 For all disputes arising from the contractual relationship, where the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is Berlin.
§ 11 GTC for Invoice & Installment Purchase

§ 12 Miscellaneous
12.1 The contract language is German.
12.2 If one or more provisions of these GTC are or become invalid, the contract shall otherwise remain valid. To the extent that provisions are invalid, the content of the contract shall be governed by statutory regulations.
